These Terms of Use ("Terms") are a legal agreement between you and the developer of KickXI ("we", "us", "our") governing your use of the KickXI mobile application (the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What KickXI Is
KickXI shows football fixtures, competitions, and statistical analysis generated by our own analytical models ("engines") from historical match data. The App surfaces statistical patterns for informational purposes only — it does not predict outcomes, does not guarantee results, and is not betting, gambling, or wagering advice. KickXI does not accept wagers, does not facilitate betting, and is not a gambling service of any kind. If you choose to use information from the App in connection with sports betting or wagering conducted elsewhere, you are solely responsible for complying with the laws of your jurisdiction, and we accept no liability for how you use that information.
2. Eligibility
KickXI is not directed at children under the age of 13. By using the App, you represent that you meet this minimum age requirement (or the higher age of majority required in your jurisdiction to enter into these Terms).
3. Accounts
You may use KickXI by signing in with your Apple ID ("Sign in with Apple") or by continuing as a Guest, tied to your device. You are responsible for maintaining the security of your device and any credentials used to access your account. A Guest account cannot be recovered if the App is deleted or you switch devices — this is a limitation of the Guest sign-in method, not a service failure.
4. Analysis and Subscriptions
Searching matches, browsing fixtures and competitions, and viewing live scores in KickXI is free and does not require a subscription. Running a full match analysis requires an active KickXI Pro subscription. KickXI Pro is an auto-renewing monthly subscription that provides unlimited match analysis for as long as your subscription remains active.
5. Content You Provide
If you add a personal note to a saved match, that note is yours — we store it only to show it back to you and never use it for any other purpose (see our Privacy Policy). You agree not to enter unlawful, infringing, or abusive content into this field. This is the only user-authored content the App collects; KickXI has no public posts, comments, or reviews.
6. Acceptable Use
You agree not to: reverse-engineer, decompile, or attempt to extract the source code of the App or its backend; circumvent, automate, or abuse rate limits or subscription checks; scrape or bulk-extract data from the App or its backend; use the App for any unlawful purpose; or interfere with the App's normal operation for other users.
7. Intellectual Property
The App, its analytical engines, branding, and design are owned by us. The KickXI name, logo, and app icon are our exclusive property and may not be copied, reproduced, or used without our prior written permission. All rights reserved. Fixture and competition data displayed in the App is sourced under license from football-data.org and remains their respective owners' data. You receive no ownership rights in the App or its content beyond the limited license to use the App described in Section 9 below.
8. Disclaimers
The App and all statistical analysis are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose. Football data depends on third-party sources and may occasionally be delayed, incomplete, or incorrect. We do not warrant that the App will be uninterrupted or error-free.
9. Apple-Specific Terms
This Section applies because KickXI is distributed through Apple's App Store, per Apple's required minimum terms for developer end-user license agreements:
- Acknowledgement. These Terms are between you and us only, not Apple, and we are solely responsible for the App and its content.
- Scope of license. We grant you a limited, non-transferable license to use the App on Apple-branded products that you own or control, as permitted by Apple's Media Services Terms and Conditions, including via Family Sharing where applicable.
- Maintenance and support. We, not Apple, are solely responsible for providing any maintenance and support for the App.
- Warranty. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, or damages are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, legal or regulatory compliance claims, and consumer protection or privacy claims.
- Intellectual property claims. In the event of a third-party claim that the App infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, and resolution of such a claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party agreements (for example, your wireless data or device agreements) when using the App.
- Third-party beneficiary. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including any decisions made based on statistical analysis shown in the App. Nothing in these Terms limits liability where such limitation is not permitted by applicable law.
11. Termination
You may stop using the App at any time and may permanently delete your account from Settings → Delete Account inside the App (see our Privacy Policy for what this does). We may suspend or terminate your access if you violate these Terms.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you through the App. Continuing to use the App after a change means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of law principles, except where applicable consumer protection law in your country of residence provides otherwise.
